Which Pinellas Beach Condos Allow Vacation Rentals
Which Pinellas Gulf beach condo buildings allow weekly or short-term rentals, how city and condo rules interact, and how to verify before you buy.
Updated October 2026.
Many investors start a beach condo search with one question: can I rent it by the week or the night? On the Pinellas Gulf beaches, the answer depends on three separate layers of rules: the city’s zoning, the condo association’s documents, and the state and county licensing and tax requirements. A building can sit in a district where the city allows short stays and still have a declaration that requires a three month minimum. This guide explains each layer, lists example buildings with their reported rental minimums, and walks through how to verify a building’s rules before you buy.
Which Pinellas Gulf beach towns allow short-term rentals?
It depends on the town and the zoning district. Indian Shores says it has no rental restrictions, Indian Rocks Beach allows rentals under 30 days with city registration, and Treasure Island, St. Pete Beach and Redington Shores allow them only in certain zoning districts. Madeira Beach R-1 and R-2, North Redington Beach residential districts and residentially zoned property in Clearwater set longer minimums. A condo association can be stricter than the city, so the building’s own minimum has the final say.
| City | Under-30-day rentals | Registration |
|---|---|---|
| St. Pete Beach | Limited to the RM district and Pass-a-Grille overlay, no more than 3 times in 12 months; 30 days or longer allowed in any district | No city registration program; commission declined one in August 2026 |
| Treasure Island | No minimum in CG, RFM-30, RFH-50, PR-MU Core and PR-MU Gulf Boulevard; turnover limits in RU-75 and RM-15 | State license, city local business tax, county tourist tax |
| Madeira Beach | Not in R-1 (6-month minimum) or R-2 (3-month minimum) unless grandfathered before Feb. 28, 2006 | City business tax receipt, state license, tourist tax |
| Redington Beach | Single-family rentals under 181 days prohibited in Districts 2 and 3, per the Realtor summary | Town vacation rental ordinance applies; confirm with the town |
| North Redington Beach | Not in residential districts; homes must be rented for more than 90 days | Confirm with the town |
| Redington Shores | Only in ROR-15 and CTF; prohibited in RS-7, RS-10, RD-15, RM-15 | Certificate of use application through the town |
| Indian Shores | Allowed; the town says it has no rental restrictions | Condo association minimums; state license and tax accounts |
| Indian Rocks Beach | Allowed with city registration | City registration ($600) plus inspection, business tax receipt, state license, tax accounts |
| Clearwater Beach (City of Clearwater) | Not on residentially zoned property (31 days or one calendar month minimum) | Confirm with the city |
Sources and details for each city are on Team BeachSide’s short-term rental rules, city by city. Rules change, so confirm with the city before you buy.
Three Layers of Rules
1. City rules and zoning
Each beach city regulates rentals of less than 30 days by zoning district, and the rules change at every city line. A few examples from official sources:
- St. Pete Beach: the city’s short-term rental one-sheet says short-term rentals are allowed in the RM district and the Pass-a-Grille overlay up to 3 times in a 12 month period, are not allowed in most single-family zones, and that each violation is a separate offense. It advises owners to check the official zoning map before renting.
- Treasure Island: the City of Treasure Island sets no minimum or maximum stay for tourist dwellings in the CG, RFM-30, RFH-50, PR-MU Core and PR-MU Gulf Boulevard districts, and limits changes of occupancy in the RU-75 and RM-15 districts.
- Madeira Beach: a City of Madeira Beach letter says rentals must be at least 6 months in the R-1 district and at least 3 months in the R-2 district, unless the property was legally rented short term before February 28, 2006.
- Redington Shores: the Town of Redington Shores allows transient rentals only in the ROR-15 and CTF districts and prohibits them in RS-7, RS-10, RD-15 and RM-15.
- North Redington Beach: the town states that homes in residential districts must be rented for more than 90 days.
- Indian Rocks Beach: the City of Indian Rocks Beach requires vacation rental registration and offers a separate condo vacation rental registration application.
Florida law generally bars local governments from prohibiting vacation rentals or regulating their duration or frequency, but that limit does not apply to local rules adopted on or before June 1, 2011, under section 509.032(7)(b), Florida Statutes. That is why some beach towns still enforce older minimum stays. Our city-by-city guide to Pinellas beaches short-term rental rules covers each city, including Indian Shores and Redington Beach. The practical step is the same everywhere: confirm the zoning district of the specific parcel with the city before you rely on short stays.
2. Condo association rules
City rules set the outer limit. The condo declaration, its amendments and the association’s rules can be stricter. Common restrictions include a minimum term of one week, 30 days or three months, a cap on the number of rentals per year, a waiting period after purchase, mandatory use of an on-site rental program, and board approval of each lease. A city that allows nightly rentals does not override a building that requires three months.
Rental rules can also change. Under section 718.110(13), Florida Statutes, an amendment that prohibits rentals, changes the rental term or limits the number of rentals applies only to owners who consent to it and to owners who take title after it takes effect. If you buy after such an amendment passes, it applies to you, even if the seller was renting weekly.
3. State license and taxes
Even where the city and the building allow short stays, the operation needs a state license and tax accounts:
- DBPR vacation rental license. The Division of Hotels and Restaurants requires a license if a unit is rented more than three times in a calendar year for periods of less than 30 days or one calendar month, whichever is less, or is advertised as regularly rented to guests. A condo unit is licensed as a Vacation Rental, Condominium. The DBPR lodging fee schedule lists $170 per year for a single rental unit, plus a one-time $50 application fee.
- Florida sales tax. Rentals of six months or less are subject to the 6 percent state sales tax plus any county discretionary surtax, according to the Florida Department of Revenue transient rental guide. The Department’s surtax rate form DR-15DSS lists Pinellas County at 1 percent, through December 31, 2029.
- Pinellas County tourist development tax. The Department of Revenue’s tourist development tax rate form DR-15TDT lists Pinellas at 6 percent, collected by the county. The Pinellas County Tax Collector says anyone collecting rent on living quarters for six months or less must register for a tourist development account.
Together, those rates add up to 13 percent of the taxable rent on a stay of six months or less. Our short-term rental tax and license checklist walks through each registration, when booking platforms collect on your behalf, and the city registrations that apply in some beach towns.

Two patterns stand out. First, weekly minimums are the most common short-stay rule we found on the beachfront, and true nightly rentals are less common in condo buildings than many buyers expect. Second, buildings in the same city can be very different: Lands End and Mansions by the Sea are both in Treasure Island, one with a reported 7 day minimum and the other monthly only. Some buildings, such as Madeira Vista and 50 Gulfside, operate an on-site rental program, which can affect your net income and whether you may rent on your own. If you are comparing a managed rental building with a hotel-style project, see our guide to condo-hotels versus standard condos and our list of beach condo-hotels.
Location matters too. Every St. Pete Beach and Pass-a-Grille building in the table reports a minimum of about three months, while the three Clearwater Beach buildings report one month. At Tides Beach Club, the Town of North Redington Beach rule and the listing sources disagree, so check the zoning before you rely on any listing.
How to Verify a Building’s Rental Rules
Listing remarks and rental sites are a starting point. The governing documents control. Here is the process we use with investor clients.
- Get the declaration and every amendment. Rental restrictions usually live in the declaration of condominium and its recorded amendments. Read the amendment history, not only the original declaration, and note the recording date of any rental amendment, since section 718.110(13) ties who is bound to that date.
- Read the rules and regulations. Boards often set procedures such as registration forms, guest check-in, parking passes, pet limits for tenants and per-rental fees in the rules rather than the declaration.
- Review the Frequently Asked Questions and Answers sheet. Under section 718.504, Florida Statutes, this disclosure must cover unit use restrictions, including restrictions on leasing. Under section 718.503, a resale seller must provide the declaration, articles, bylaws, rules, budget and financial statement, and the buyer has a 7 day cancellation window, excluding weekends and legal holidays, after receiving them.
- Ask about approval and timing. Find out whether the board must approve each lease or each new owner, how long approval takes, whether there is a waiting period after purchase before you may rent, and whether there is a cap on rentals per year.
- Ask about rental programs and fees. Confirm whether owners must use an on-site rental office, what it charges, and whether there are per-rental fees.
- Check for pending amendments. Read recent board and owner meeting minutes for any proposal to change rental terms. A rental amendment approved after you close would not bind you unless you consent, but one approved before you close would.
- Confirm the city zoning. Ask the city which zoning district the parcel is in and what that district allows, and whether the city requires a local registration or business tax receipt.
- Request the seller’s records. If the unit has been rented short term, ask for the DBPR license, tax account records and booking history. Those records show the unit has operated legally and help you test rent projections.
Run the Numbers With the Real Minimum
A 7 day minimum, a 30 day minimum and a 3 month minimum produce very different occupancy and revenue. Model the rule you verified, not the one in the listing remarks. Our Gulf beach rental investment analyzer lets you test occupancy, nightly or weekly rates, management fees, HOA dues and insurance. For how dues, reserves and assessments affect returns, read beach condo cash flow after Florida’s condo safety laws.

Frequently asked questions
Can a condo association be stricter than the city on short-term rentals?
Yes. The city sets the outer limit by zoning district, but the declaration, amendments and rules can require a longer minimum, cap rentals per year or require board approval. A city that allows nightly stays does not override a building that requires three months.
Does a new rental amendment apply to me if I buy after it passes?
Yes. Under section 718.110(13), Florida Statutes, an amendment that prohibits rentals, changes the rental term or limits the number of rentals applies to owners who consent and to owners who take title after it takes effect.
Do I need a state license to rent a condo weekly?
Usually. DBPR requires a vacation rental license if a unit is rented more than three times in a calendar year for periods of less than 30 days or one calendar month, or is advertised as regularly rented to guests. Condo units are licensed as Vacation Rental, Condominium.
How do I confirm a building allows weekly rentals?
Read the declaration and every recorded amendment, the rules, and the Frequently Asked Questions and Answers sheet, then ask the association about approval, waiting periods, rental caps and pending amendments. Also confirm the parcel zoning with the city.
